A federal judge has permitted a class-action lawsuit against Abbott Laboratories for allegedly misleading claims about its PediaSure nutritional drinks.
A US federal judge has ruled that Abbott Laboratories must face a proposed class-action lawsuit alleging that the company's PediaSure Grow & Gain nutritional drinks misled consumers by claiming they were clinically proven to help children grow taller. The decision comes after plaintiffs argued that such claims were unsubstantiated and violated consumer protection laws.
The lawsuit, which was initially filed in 2021, alleges that Abbott made false and misleading statements about the effectiveness of PediaSure products. According to the plaintiffs, these claims were not supported by scientific evidence and misled parents into believing their children would experience significant growth benefits from using the product.
In his ruling, Judge Edward Chen of the Northern District of California there was sufficient evidence for the case to proceed. "The allegations raise serious questions about whether Abbott's marketing practices are misleading," said Chen in a statement. "Consumers have a right to accurate information when making purchasing decisions."
Plaintiffs' attorneys argue that PediaSure advertisements and packaging prominently featured claims of clinical studies supporting growth benefits, which they claim were not based on credible scientific research. The lawsuit seeks damages for consumers who purchased the product based on these misleading claims.
"Abbott has a responsibility to ensure their marketing is truthful and backed by evidence," said attorney Michael Lieff, representing the plaintiffs. "We are pleased that the court recognized the importance of holding companies accountable when they make false promises to consumers."
