CCP Approves Acquisition of Turkish Logistics Firm by CMA CGM

The Competition Commission of Pakistan (CCP) has officially sanctioned the acquisition of Borusan Tedarik Zinciri Cozumleri ve Teknoloji Anonim Sirketi (Borusan), a Turkish third-party logistics company, by CMA CGM S.A., a global leader in shipping and logistics.

According to an official statement, the commission assessed the proposed merger in accordance with Section 11 of the Competition Act, 2010, alongside the Competition (Merger Control) Regulations, 2016.

This transaction involves CMA CGM obtaining complete ownership of Borusan from its existing stakeholders, Borusan Holding AS and Borusan Yatirim ve Pazarlama AS, both of which are located in Türkiye.

CMA CGM, with its headquarters in France, holds a prominent position in container shipping and port terminal operations, extending its presence to Pakistan through CEVA Logistics Pakistan Pvt. Ltd and CEVA Air and Ocean Pakistan Pvt. Ltd.

Borusan’s primary focus is within the Turkish logistics market, with only a limited engagement in Pakistan facilitated through a local representative.

The CCP’s evaluation determined that the merger is unlikely to raise substantial competition issues within the Pakistani market, specifically concerning freight forwarding services by air and sea.

The Commission determined that the transaction would not lead to the creation of a dominant market position or the imposition of considerable barriers to entry for other industry participants.

This approval underscores the Commission’s ongoing dedication to promoting international investments while upholding fair competition principles in the marketplace.
